6. Disclaimers and Warranties
The Plant Patch strives to provide high-quality gardening services, but certain limitations and factors are beyond our control.
- Service Outcomes: While we use our best efforts and expertise, The Plant Patch cannot guarantee the long-term survival, specific growth rates, or complete eradication of all pests or diseases for plants, as these outcomes are influenced by numerous external factors including, but not limited to, weather conditions, client adherence to after-care instructions, pre-existing plant conditions, and environmental changes.
- Organic Methods: We prioritize organic-first care methods. While effective, these methods may require more consistent application or take longer to show results compared to synthetic alternatives. We are not responsible for results that may differ from those achieved with non-organic methods.
- Website "As Is": The Website and Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The Plant Patch does not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components.
- Accuracy of Information: While we endeavor to keep the information on the Website accurate and up-to-date, we do not warrant the completeness or accuracy of the information, including pricing, service descriptions, or blog content. Any reliance you place on such information is therefore strictly at your own risk.
7. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall The Plant Patch, its affiliates, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Website or Services;
- Any conduct or content of any third party on the Website or Services;
- Any content obtained from the Website or Services; and
- Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
In no event shall the aggregate liability of The Plant Patch for all claims relating to the Services exceed the amount you paid to The Plant Patch for the specific services giving rise to the claim in the twelve (12) months preceding the claim. This limitation of liability is a fundamental element of the basis of the bargain between you and The Plant Patch.
8. Indemnification
You agree to defend, indemnify, and hold harmless The Plant Patch, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

This indemnification obligation will survive the termination of these Terms and your use of the Website and Services.
9. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be resolved through good faith negotiation between the parties. The arbitration shall be conducted in Garden City, Georgia, United States. The decision of the arbitrator shall be final and binding upon both parties, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
You agree that any claims or disputes that you may have against The Plant Patch will be resolved on an individual basis, and you hereby waive your right to participate in any class action lawsuit or class-wide arbitration.
10. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Website or Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the Website and the Services. We encourage you to periodically review these Terms to stay informed of our updates.
